New York's prevailing wage requirements are among the most complex in the country. Rates vary by county, trade, and project type. They change multiple times per year. And the penalties for getting it wrong are severe. Here's what Long Island contractors need to know.
How NY Prevailing Wage Rates Work
The New York State Department of Labor publishes prevailing wage schedules for each county. For Long Island contractors, you're primarily dealing with:
- Suffolk County rates — Generally slightly lower than Nassau
- Nassau County rates — Often aligned with NYC rates due to proximity
- NYC rates — Highest in the state (relevant if you work in the five boroughs)
Rates include two components:
- Base hourly rate — The minimum cash wage
- Supplemental benefits (fringe) — Health, pension, annuity, training, holiday pay
You must pay BOTH. The fringe can be paid as cash (added to the hourly rate) or through qualifying benefit plans.
Finding Current Rates
Current prevailing wage schedules are published on the NYS DOL website (wpp.labor.state.ny.us). You need:
- The PRC number (Prevailing Rate Case number) for your specific project
- The trade classification for each worker
- The effective date — rates change, sometimes mid-project
Critical: The rate that applies is the rate in effect on the date the work is performed, not the date the contract was signed. If rates increase mid-project, you must pay the new rate going forward.

While both counties are on Long Island, their prevailing wage rates can differ significantly for certain trades:

Bidding Prevailing Wage Work Profitably
Many contractors avoid public work because "the paperwork isn't worth it." That's a mistake. Prevailing wage jobs can be highly profitable because:
- Everyone pays the same labor rates — competition is on efficiency, not wage-cutting
- The rates include fringe — if you have efficient benefit plans, the cash equivalent exceeds your actual cost
- Payment is more reliable — public entities pay (eventually), and you have lien rights
The key is accurate estimating. Your labor cost on a prevailing wage job is NOT your normal shop rate. You need to bid using the actual prevailing rate (base + fringe) as your labor cost, then add your markup for overhead and profit.
Compliance Tips for Long Island Contractors
- Check rates before bidding — Don't assume last year's rates still apply
- Track hours by project daily — Not weekly, daily. The DOL wants to see daily breakdowns.
- Keep 6 years of records — NY statute of limitations for wage claims
- Train your foremen — They're the ones recording hours in the field. They need to understand classification rules.
- Submit certified payroll on time — Weekly, within 7 days of the pay period end
